Cody Posey

Cody Posey' (born October 9, 1989 in New Mexico, United States) is a convicted murderer who was, according to Jack Thompson, trained by Grand Theft Auto: Vice City to be more aggresive and a more effective killer.

On July 5, 2004, Cody Posey killed his father, Paul Posey, his stepmother, Tryone Schmid, and stepsister, Marilea Schmid. Posey, after his arrest two days later, told police the murders occured after an argument with his father and stated that the night before, his father had attempted to make him have sex with his stepmother. Cody admitted to killing his stepmother first so she could not phone the police, before shooting his step sister twice and his father as they ran to the scene. Cody later buried the bodies in a shallow grave of manure after failing to bury them on a nearby plot of land. Cody subsequently drove his fathers truck into town and stayed with friends. Sam Donaldson, the ranch owner, discovered the bodies upon visiting the ranch.

Cody was arrested two days after the murders and the murder trial began on January 16, 2006. His defense attorney, Gary Mitchell, never denied that Cody was responsible for the murders but argued that they occured as a result of years of abuse and dissociation. Cody's teachers, classmates and fellow ranch hands corroborated claims that Cody's parents abused him. The trial lasted for three weeks and finished on February 7. Cody was convicted of first degree murder in the death of his stepsister, second degree murder in the death of his stepmother, and voluntary manslaughter in the death of his father. On February 23 Cody was sentenced by Judge Counts as a juvenile and sentenced to remain in the custody of juvenile authorities until the age of 21.

Attorney Jack Thompson filed a wrongful death lawsuit on September 25, 2006, which named Cody on behalf of the surviving Posey relatives. The lawsuit also named Rockstar Games (the creator of the Grand Theft Auto games), publisher Take-Two Interactive and Sony (the manufacturer of the PlayStation 2). Thompson claimed that Cody was trained by Grand Theft Auto: Vice City to be more aggressive and to be a more effective killer. The lawsuit was thrown out by a New Mexico judge on December 19, 2007 as neither Sony or Take-Two have offices in New Mexico.

Cody Posey was released from the custody of juvenile authorities on October 9, 2010, having completed his high school degree and two years of college. While in the juvenile system he had no disciplinary issues and became a mentor to younger boys.
