The police helicopter does in fact shoot at you if you have a 3 star wanted level. As with higher wanted levels, it will only shoot at you if you are in its spotlight for a few seconds, this also happens if you are in a vehicle, and it is very common for the helicopter to constantly shoot at you while going slowly uphill in a Rhino.
