The author asserts that this image qualifies for fair use for the following reasons:

Rockstar Games and its subsidiaries have not release game screenshots into public domain.
The image is necessary to illustrate vehicles in Grand Theft Auto III and Grand Theft Auto: Liberty City Stories, nothing else.
The image is not intended to hinder the copyright owners' ability to market and sell their games.
